Nederland kartrekker Europees PFAS verbod

Er moet een Europees verbod op PFAS komen. Dat voorstel van Nederland krijgt ruimte steun in de Milieuraad in Brussel. Minister van Veldhoven (Milieu) is kartrekker van het zogenoemde restrictievoorstel.

 Hierdoor wordt PFAS in alle niet-essentiële toepassingen verboden. Een belangrijke stap om de kraan voor het gebruik van deze schadelijke stoffen dicht te draaien.

Van Veldhoven: “Ik vind dat we de kraan voor PFAS moeten dichtdraaien. Het teflon laagje is misschien handig in een pan, tegelijkertijd breken deze stoffen nooit meer af in ons milieu en kunnen ze schadelijk zijn voor onze gezondheid. PFAS komt nog iedere dag aan alle kanten ons land binnen. We kunnen dit niet in ons eentje oplossen en moeten het probleem aan de voorkant in heel Europa aanpakken. Zodat PFAS überhaupt niet meer gebruikt en uitgestoten wordt.”

Vermoedelijk kankerverwekkend

In 2018 werd bekend dat PFAS verspreid zit in heel het land. PFAS is de verzamelnaam voor zo’n 6000 stoffen die door de mens gemaakt zijn, sommigen daarvan zijn vermoedelijk kankerverwekkend. Duidelijk is dat de stoffen eenmaal in het milieu nooit meer afbreken. Sinds de verspreiding van PFAS in de bodem bekend is, zijn meerdere acties in gang gezet om ons milieu en onze gezondheid te beschermen. Tegelijkertijd werkt het kabinet met man en macht om te zorgen dat bouwers en baggeraars die met PFAS-houdende grond en bagger te maken hebben zo min mogelijk hinder ondervinden. Het PFAS-probleem aan de voorkant aanpakken, met een Europees verbod, is een belangrijke stap om deze problemen in de toekomst te voorkomen.

Meest uitgebreide verbod ooit

Bijzonder aan dit restrictievoorstel is dat alle schadelijke PFAS stoffen, zo’n 6000 in totaal, voor het eerst in één keer verboden gaan worden. Dat maakt dit de meest uitgebreide en complexe restrictie die tot nu toe is opgepakt onder de Europese verordening REACH. Deze verordening van de Europese Unie heeft als doel de gezondheid van de mens en het milieu beter te beschermen tegen de risico's die chemische stoffen kunnen opleveren. Het is belangrijk alle 6000 stoffen die onder PFAS vallen in één keer samen te nemen, omdat zo voorkomen wordt dat de ene PFAS door de andere PFAS wordt vervangen. Zo ging de industrie bij het verbod op de stof PFOA in 2008 over op het ‘broertje’ van PFOA: GenX. Ook een schadelijke stof met een net iets andere structuur. Dat waterbedeffect wil het kabinet voorkomen.

Stappen tot een verbod

Het duurt naar verwachting vijf jaar voor het verbod in werking treedt. Dat komt door de uitgebreide procedure. Een EU-lidstaat of het Europees Chemicaliën Agentschap kunnen de restrictieprocedure starten als ze menen dat een stof een onaanvaardbaar risico voor gezondheid of milieu oplevert. De eerste stap is dat Nederland beschrijft waarom de restrictie nodig is, inclusief risico’s, alternatieven, kosten daarvan, en verwachte voordelen voor milieu en gezondheid dankzij de restrictie. Daarna bepalen wetenschappelijke comités of de voorgestelde restrictie effectief is, of de maatschappelijke kosten opwegen tegen en de baten en de geschiktheid van alternatieven. Vervolgens is de Europese Commissie aan zet. Die schrijft een wijzigingsvoorstel voor de lijst van restricties onder de REACH-richtlijn. De Raad en het Europese Parlement ebben die maanden om bezwaar te maken. Tenslotte treedt de restrictie na een overgangsperiode in werking.

‘Tackling the sources of pollution is the only structural remedy of further pollution. Therefore I intend to draft a broad REACH restriction proposal to eliminate all non-essential uses of PFAS in the EU.’ Dat zegt minister Van Veldhoven op 19 december in de Milieuraad in Brussel.

  • I would like to thank The Presidency for the opportunity to address the issue of per and polyfluorinated substances, known as PFAS. 

  • Comprising of thousands of chemicals, these are man-made chemicals that are persistent and accumulate over time in humans and the environment.

  • Most studied PFAS are considered highly toxic and pose risks to health and environment.

  • This year we discovered that in the Netherlands PFAS can be found in our soil everywhere.

  • Not only in the Netherlands, but around the world, wide spread contamination has become a serious concern.

  • It is evident that we urgently need to take action. And, tackling the sources of pollution is the only structural remedy.

  • To prevent further contamination, I intend to draft a broad REACH restriction proposal to eliminate all non-essential uses of PFAS in the EU.

  • This proposal will address all PFAS substances, to prevent substitution of one PFAS by another.

  • To develop this proposal, information is needed related to PFAS applications, emissions, damages, and alternatives. I invite you to share all relevant information to allow us to develop a truly comprehensive and accurate overview.

  • This will not be an easy task. I am grateful for the support offered by other colleagues in the further process of the proposal.

  • That said, tackling all non-essential uses of PFAS will not be enough. We need a more comprehensive EU approach to tackle the challenge of persistent chemicals, and specifically PFAS.

    I therefore support the initiative by Sweden and others, to request, the Commissions to develop an EU PFAS action plan.

  • To conclude, I want to stress that we aim to do our utmost to minimize chemicals related risks citizens are exposed to on a daily basis.

  • In follow-up to the Green Deal communication, I therefore urge the Commission to ensure that the chemicals strategy aims at a non-toxic environment. And, that it provides us with all necessary regulatory developments to anticipate and address the rapidly developing challenges we face, when protecting the health of our citizens and the environment.

  • I would like call on all colleagues to take all feasible measures to reduce PFAS emissions of installations producing or making products containing PFAS.

  • In the Netherlands, a large producer of PFAS achieved a 99% emission reduction against limited costs. This may well be possible in other Member States as well. We would be happy to share information on how to achieve such a reduction.
